Pretoria - Two more charges – of rape and sexual assault – have been filed against the man charged with manufacturing and distributing child pornography.
The man, who cannot be named due to the nature of the charges and to protect the identity of the minors, is facing two more charges of rape and sexual assault and has applied for bail for other child pornography and rape charges. His daughter is said to be one of the victims he raped and sexually assaulted.
Magistrate Desmond Nair is considering his bail application in the Pretoria Magistrate’s Court.
The 56-year-old man’s wife testified he should be granted bail because he is the sole breadwinner and she would be unable to pay the family’s expenses should he be incarcerated while awaiting trial.
She also testified that she did not condone the fact that he had an extra-marital affair, but she wanted him to be granted bail so he could support her or sort out their financial situation.
The accused, and his co-accused, a 42-year-old woman, met on a dating site and began an extra-marital affair.
The woman allegedly sent pictures of naked minors to his phone and invited him to her house where young girls – who were naked – were paraded in front of him and his nephew and she encouraged them to take photos.
Last Wednesday he testified of two girls walking in on him and the woman while they were having sex and one of the two minors grabbed his hand and put it on her private parts. The investigating officer testified against the man getting bail as he could intimidate the witnesses.
“Why should the children be put under pressure by putting them in a place of safety and take them out of their school just to allow the accused to get bail,” he said.
He testified that if the accused was not guilty he would not have returned to his co-accused’s home for a third or fourth time to keep taking pictures of the minors. These were allegedly photographed naked and posing in different positions with their genitals exposed.
The defence said the state had failed to prove there was public outrage, that he was a flight risk or he would intimidate the witnesses.
Nair will deliver judgment on Monday.
